Our experience spans every stage in the life cycle of construction projects, from initial structuring to preparing requests for proposals (RFPs) and bidding documents; negotiation of contracts with architects, engineers, contractors, consultants, neighboring owners, and others; construction administration; LEED certification; casualty events during construction or operations; dispute resolution (including resolution of mechanic’s liens); and close-out/completion. We have developed custom forms of agreement for the various types of contract structures that our clients may consider, including lump sum, guaranteed maximum price (GMP), design/build, construction management, and consulting agreements, and are conversant with the AIA document library. Our experience includes representation of the following clients: • The Governor’s Office of Storm Recovery on the Living Breakwaters coastal resilience project along Staten Island’s southeast shoreline, as part of the post- Superstorm Sandy Rebuild by Design initiative. This project involved in-water construction and work on shore. • Amtrak with respect to the construction and development of several major capital projects critical to the continued success of its rail operations in New York, including the Gateway Tunnel project beneath the Hudson Yards Development and Moynihan Station. • A commercial developer in over $300 million of ground- up residential construction in New York and along the East Coast. • Marquee cultural institution projects, including ◦ A prominent off-Broadway theater organization in connection with the design and construction of major renovations to its Broadway building. ◦ Lincoln Center for the Performing Arts with respect to several marquee projects, including the proposed renovation of David Geffen Hall and the $1+ billion redevelopment and renovation of the Lincoln Center campus. ◦ New York Shakespeare Festival/The Public Theater on projects ranging from rehearsal and performance spaces to office space. ◦ The $100+ million renovation of one of the country’s oldest operating museums, located in western New York. • Private schools, colleges, and universities, including: ◦ Riverdale Country School in the design and construction of a new natatorium, academic building, and extensive gymnasium renovations. ◦ The Spence School in connection with its new athletic center project. ◦ A New York City independent school in expansion, redevelopment, and new school construction projects. • Civic and charitable organizations, including: ◦ Madison Square Boys and Girls Club in the design, construction, and financing of its Pinkerton Clubhouse in Harlem. ◦ A New York not-for-profit charitable housing provider seeking to replace its aging facilities by engaging in a complex, multi-phase exchange transaction with a commercial developer. ◦ Clinton Housing Development Company in the preparation of master forms of construction and design contracts, drafted to comply with NYC Housing Preservation and Development and U.S. Housing and Urban Development requirements, for the construction and renovation of its affordable housing portfolio. • The owner of a 600+-facility hotel chain in the negotiation of a master architectural agreement with an internationally recognized design firm to implement a portfolio-wide renovation and create a new prototype facility for future construction. • A nationwide healthcare facility operator in the design and construction of new and renovated skilled nursing and assisted living facilities throughout the country. • Tradepoint Atlantic in connection with the funding and construction of infrastructure for the redevelopment of the former Sparrows Point steel plant in Baltimore County, Maryland as a 3,000+-acre multimodal mixed- use industrial campus, including contracts with Baltimore County and contractors for the construction of water and sewer lines, roads, and port facilities, as well as county and federal funding agreements for these improvements. • Serving as general outside construction counsel to the Archdiocese of New York with respect to the development, construction, and renovation of multiple facilities owned and operated by the Archdiocese and by the several parishes within its network. The work spans marquee projects, such as the renovation of St. Patrick’s Cathedral, and routine design and construction contract negotiations and dispute resolution related to same. We understand the unique issues facing quasi-governmental agencies, independent schools, religious institutions, universities, cultural institutions, and healthcare, transportation, utility, and hospitality companies undertaking major development and construction projects.
